1. Acceptance of Terms

By accessing or using Lost & Found Birds at lost-found.birdsittingtoronto.ca (the "Portal"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Portal. The Portal is operated by Bird Sitting Toronto.

2. Description of Service

The Portal is a free community service that helps connect owners of lost pet birds with people who have found them. We provide a platform for posting listings, searching reports, receiving email alerts, and sharing information. We do not guarantee any outcome or reunion.

3. User Conduct

You agree not to:

• Post false, misleading, or fraudulent information.
• Submit content that infringes on intellectual property rights.
• Use the Portal for commercial purposes or to advertise products/services.
• Attempt to collect personal information of other users for unauthorized purposes.
• Submit spam, automated requests, or use bots to interact with the Portal.
• Upload malicious files, viruses, or harmful content.
• Harass, threaten, or abuse other users.
• Impersonate another person or entity.
• Use the Portal in connection with bird trafficking, illegal wildlife trade, or any unlawful activity.

4. Content Moderation

All submitted posts are subject to review before being published. We reserve the right to reject, remove, or modify any content at our sole discretion. Content that violates these Terms, contains inappropriate material, or appears fraudulent will be removed without notice.

5. User Content

By submitting content (posts, images, stories, sightings) to the Portal, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and use that content in connection with operating the Portal. You retain ownership of your content and may delete it at any time using your management token.

6. Privacy

Your use of the Portal is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Disclaimer of Warranties

The Portal is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Portal will be uninterrupted, error-free, or secure. We do not verify the accuracy or truthfulness of user-submitted content.

8. Limitation of Liability

To the maximum extent permitted by law, Bird Sitting Toronto and its operators shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or relating to your use of the Portal. This includes, but is not limited to, damages from failed reunions, incorrect information, data loss, or interactions with other users.

9. Indemnification

You agree to indemnify and hold harmless Bird Sitting Toronto from any claims, damages, or expenses arising from your use of the Portal or your violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to the Portal at any time, for any reason, without notice. Upon termination, your right to use the Portal ceases immediately.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

12. Changes to Terms

We may modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Portal after changes constitutes acceptance of the new Terms.
